The Directorate of Public Prosecutions (DPP), Ministry of Justice, Lagos State has recommended that an immigration officer, Umar Mohammed be prosecuted for allegedly assaulting his colleague, Badiru Olayemi Oluwafemi.
The recommendation was contained in a legal notice dated October 6, but received October 20, 2021 on the case marked : “CR NO: 1616/2021”, between Lagos State Commissioner of Police and Umar Mohammed.
The legal advice obtained by The Guardian, yesterday was addressed to the Lagos State Deputy Commissioner of Police .
It was reported that Mohammed allegedly struck Badiru on his face with his fist
According to the document signed by the Director of DPP, Adetutu Oshinusi, despite denying the fact that he (suspect) struck the victim on his face, an apology letter reportedly signed by him put this in doubt.
The document stressed that there are sufficient facts to establish the offence of “assault occasioning harm and serious assault” contrary to Sections 173 and 174 of 2015 Lagos State Criminal Law, Ch. C17, Col 3.
This, according to the legal advice, proved that Umar was guilty of the allegation. The document reads in parts: “The fact available in the duplicate case file reveal that despite that Umar denied that he struck Badiru on the face with his fist, a letter of apology signed by the suspect, the report of a committee set up by Nigerian Immigration Services to investigate the allegation of assault against DSI Badiru and the interim report on the case of assault against DSI Badiru are clear facts that Umar Mohammed assaulted Badiru Adeyemi Olufemi.
“That Umar struck, touched, moved, or otherwise applied force of any kind to the person of Badiru, either directly or indirectly, without his consent. That the strike was non-consensual, and that the strike caused injury to the victim.” It further stated that confessional statements, circumstantial evidence and evidence of eyewitnesses proved the suspect guilty.
